Although litigation has its advantages, it can be expensive, inflexible and time-consuming. That’s why more and more disputes are now being resolved out of court using alternative dispute resolution (ADR). As the use of ADR increases, there’s never been a better time to train with CIArb.

The aim of this course is to provide an understanding of the relevant principles in the law of tort and the law of contract in the context of how disputes may arise and be resolved. This course is designed to consider both common and civil law jurisdictional principles to give a solid grounding to all practitioners.

This course is intended for individuals who may not have studied law previously and wish to gain an understanding of the elements of the law of obligations that affect matters in civil and commercial disputes in a variety of different jurisdictions. It is suitable for anyone with a general interest in dispute resolution and is essential for individuals who wish to go on to become qualified Arbitrators, Adjudicators or Mediators. It is also suitable for those from either system of law wishing to improve or refresh their knowledge of the more unfamiliar system of law.

Past Courses – 2017

CIArb Asia Pacific Diploma in International Commercial Arbitration (21-29 October 2017)

The 2nd CIArb Asia Pacific Diploma in International Commercial Arbitration was held in Hong Kong from 21 to 29 October 2017. The course was jointly organised by the Australia, East Asia and Singapore branches of the Chartered Institute of Arbitrators and its inaugural edition in Singapore was successfully launched in 2016.

The course faculty comprised international arbitration experts from across Asia-Pacific and around the world led by the course directors Richard Leung and Francis Xavier SC, Immediate Past Chairmen for East Asia Branch and Singapore respectively.

A record-breaking participation of 36 participants from Australia, Singapore, India, Switzerland, Germany, Philippines, Indonesia, France, Italy, Oman, Mexico other than Hong Kong and Mainland China attended the course.

The course venues were sponsored by King & Wood Mallesons, Stevenson Wong & Co, Hong Kong International Arbitration Centre (HKIAC) and Cliftons Hong Kong.

During the interactive 9-day program, participants were exposed to the practice of international commercial arbitration, covering major forms of arbitration and arbitration institutions such as ICC, ACICA, HKIAC, SIAC and CIETAC with the mission to help participants to gain the ability to appear in or act as an arbitrator or counsel in different contexts. In addition, participants also took part in practical group workshops under the guidance of experienced arbitrators and were given practical training addressing a range of problems which may arise in the course of conducting an international arbitration.

Apart from attending classes and tutorial workshop, participants also joined in 3 social networking events: Casual Meet & Greet Session at the Empire Hotel Wan Chai Hong Kong; The Symphony of Light Boat Cruise sponsored by Des Voeux Chambers and a special Gala Dinner hosted at the prestigious Hong Kong Bankers Club which was attended by Guest of Honour, Mr Wesley Wong SC, Solicitor General of Hong Kong.

Mr. Wesley Wong SC during his Opening Remarks mentioned,
“On a more serious note, I don’t think it is any exaggeration to say that the Chartered Institute of Arbitrators is part and parcel of the history of a determined global attempt which has led to the success of raising the status of arbitration to the dignity of a distinct and recognise position as one of the learned professions.

As a matter of fact, the promotion of private dispute resolution has been one of the Government’s top policy objectives, as can be seen in all annual Policy Addresses since 2013 in two successive terms of government, including that promulgated by the incumbent Chief Executive Mrs Carrie Lam two weeks ago (11 October 2017).”

This is an assessment programme as opposed to a teaching module. Learning will be based on private study prior to the oral assessment workshop, reinforced by tutor input and peer discussion during the workshop. Introduction to International Arbitration (BIAC) - (19 - 20 January 2017)

The Chartered Institute of Arbitrators (CIArb) Singapore Branch was delighted to receive a delegation from the Bangladesh International Arbitration Centre (BIAC) to attend the Introduction to International Arbitration course in Singapore on 19-20 January 2017. This 2-day training was successfully organised and well attended by 47 delegates from the public and private sectors of Bangladesh. The course provided an understanding of the general principles of international (i.e. non-domestic) arbitration and its relationship to other dispute resolution processes, as well as an introduction to the legal framework of, and good practice and procedure in, international arbitration in their jurisdiction.

Led by Mr. Francis Xavier (Chairman, CIArb Singapore) & Mr. Chou Sean Yu (Vice-Chairman, CIArb Singapore), the teaching team included Ms. Sapna Jhangiani, Ms. Amanda Lees and Mr Paul Sandosham as well as two guest speakers Ms. Delphine Ho from SIAC and Mr. Abhinav Bhushan from the International Chamber of Commerce (ICC).

Mr. Shahidul Haque, Secretary to the Legislative and Parliamentary Affairs division of the Ministry of Law, Justice and Parliamentary affairs of Bangladesh, graced the inaugural ceremony together with distinguished guests Ms Lim Seok Hui, Chief Executive of Singapore International Arbitration Centre (SIAC), Mr. Muhammad A. (Rumee) Ali, CEO of BIAC and Mr Ataur Rahman, Secretary General of ICC Bangladesh. The ceremony also witnessed the signing of the Memorandum of Understanding (MoU) between BIAC and the Singapore International Arbitration Centre (SIAC) to foster closer alliance and partnership.

Besides being a learning platform, there were ample opportunities for delegates, speakers and guests to meet and network, which was a great takeaway from the event.

The Branch held an Introduction Course on international arbitration in Vietnam on 31 July and 1 August 2015, with the support of Rajah & Tann LCT law firm. The course was very well attended with a total of 47 candidates, who were mainly lawyers from Vietnam, who were very enthusiastic and showed a great interest in international arbitration. The course focussed on the UNCITRAL Model Law and UNCITRAL Rules. The course tutors and lecturers were Richard Tan, Francis Xavier SC, Chou Sean Yu and Kelvin Poon. There was also a special session on Institutional Arbitration and we were delighted and honoured to have as guest speakers, Mr Michael D. Lee, representing the ICDR, the international division of the American Arbitration Association and Ms Sylvia Lee, representing the ICC International Court of Arbitration.
